Eric Silva has spent nearly three decades on the defense side of California workers' compensation, representing employers, insurance carriers, and third-party administrators before the WCAB. His practice centers on contested claims that require sustained litigation — cross-examination of medical experts, hearing strategy, and case resolution that protects a client's loss experience over the long term.

Jacob Luna co-founded the firm in 2016 to give employers and carriers a defense practice built entirely around workers' compensation — not a general-practice firm handling claims on the side. He works directly with risk managers and claims examiners to set litigation strategy early, so cases are trial-ready long before they reach a hearing.

Does the firm represent injured workers?+

No. Luna Silva Law represents employers, insurance carriers, third-party administrators, and self-insured entities exclusively — we do not take applicant-side cases.

What areas of California do you cover?+

Our attorneys appear before WCAB venues throughout California. Reach out with your venue and we'll confirm coverage before you assign the file.

What do you need to evaluate a new claim?+

The claim number, carrier or TPA name, a copy of the DOR or Application for Adjudication, and any medical-legal reports already in the file. We can begin an initial assessment from there.

How does the firm bill?+

Billing arrangements are set at intake and vary by client relationship — hourly, panel-counsel rates, or program-based arrangements for higher-volume claims administrators. We're upfront about litigation costs before a case moves forward.
